This module examines fundamental rights under the Constitution of Ireland and related rights under the European Convention on Human Rights. It is intended to provide students with the knowledge and understanding that is required of those who seek to enter professional training courses for lawyers in Ireland, as well as a foundation for an informed and critical discussion of the role of this part of Irish constitutional law in politics and society.

Learning Outcomes:

On completion of the module students should be able to:

* correctly categorize and analyse constitutional and human rights and claims made in relation to them
* recognize the relevant issues in a problem question on this topic and make relevant arguments in relation to solutions to it
* discuss the development of this part of Irish constitutional law in its historical, social and cultural context
* formulate and evaluate arguments about the role of this part of Irish constitutional law in politics and society and changes that may be appropriate in that respect

Students will examine the main fundamental rights that are protected under the Constitution of Ireland, related rights under the European Convention on Human Rights and the role of courts and other institutions in protecting them.

Approaches to Teaching and Learning:
Lectures will form the basis on which students' knowledge and understanding of the subject is based, supplemented by seminars which enable a deeper exploration of the issues in a smaller group. The seminars will consist of an equal amount of student-led, small-group discussions (in groups of 3-4) and subsequent whole-class, instructor-led discussion of the same topics. The students' coursework will give an opportunity for further feedback and learning.
