Academic Year 2021/2022

The module involves a detailed examination of the law of negligence. It will trace the historical evolution of negligence to its current format examining the forms of liability that arise in negligence from misstatements to pure economic loss to nervous shock and omissions. The standard of care and causation are also covered giving the complete picture of how liability is negligence is imposed. The purpose is to demonstrate how prolific this tort is in ts modern guise.

Learning Outcomes:

To have an in depth knowledge of the legal principles applicable in each discrete area of negligence and the application of those principles to novel factual scenarios.

Indicative Module Content:

Historical evolution of negligence; the duty of care, liability for omissions, misstatements, post traumatic stress disorder, pure economic loss, public authorities, medical negligence, the standard of care, causation and remoteness of damage.
