This module explores the ambiguous nature of corporate and white-collar wrongdoing, behaviour which often straddles the boundaries between criminal and non-criminal wrongdoing, and which often combines the respectable person and the criminal in one figure. Key topics for analysis include: investigation, trial and punishment; compliance and sanctioning models of corporate enforcement; corporate criminal liability and individual responsibility; and regulatory responses as indicators of social change.

Learning Outcomes:

On completion of this module, students should be able to:

1. Outline the nature and characteristics of corporate and white-collar crimes.
2. Distinguish between sanctioning and compliance-orientated models of corporate enforcement, exercising an appreciation for the relative strengths and weaknesses of each model, and their overlapping nature.
3. Outline the Irish experience of addressing corporate misbehaviour, recognising the social, political and economic context to enforcement.
4. Critically describe the various procedures in place for the investigation, prosecution and punishment of corporate wrongdoers, including the various due process protections in place, demonstrating an awareness of the problems associated with these mechanisms.
