This module examines the Irish Civil Processright from accrual of cause of action through to execution of judgment. Topics to be examined include - accrual of cause of action, limitation periods and statutes of limitation; civil jurisdiction of the courts; initiation of proceedings, including summonses and service; pre-trial aspects such as injunctions and discovery; aspects of the civil trial including the burden of proof, and the role of expert witnesses; enforcement and execution of judgment. Attention will also be given to alternative forms of dispute resolution ("ADR") including mediation and arbitration. There is also a focus on the history of civil procedure and the influence it has had on the development of modern civil law.

** Penultimate and final year Law students are not permitted to register to this module as their in programme or Horizons elective.**

About this Module

Learning Outcomes:

Having completed this module students will be able to:- discuss the influence of civil procedure on modern civil law; - iidentify when a civil cause of action accrues and advise on the time limits for initiation of a civil action;- advise whether a given dispute is appropriate for Alternative Dispute Resolution procedures and discuss the pros and cons of various types of dispute resolution process; - identify the correct court in which to commence proceedings and explain the apropriate type of process to be used; - discuss the use of injunctions and discovery in civil proceedings; - explain the proceedings in a civil trial;- outline the process for execution of judgment in Irish Law,and generally advise a party to an Irish civil dispute on their options in a given case.
